Hotel refunds mans money for stolen yacht - (which admits guilt)

I don't know about everyone else but when you refund a mans money because you cannot get him coast guard documentation because boat was stolen tells me you were guilty. I have talked to man from Jacksonville who got money refunded but it still cost him thousands in repairs on boat-legal fees- and more which they didn't even offer to refund. A Ft. Lauderdale sergeant called me Friday letting me know my boat was still ok and that the marina got a letter from Alan eckstein the hotels attorney advising marina not to release my boat to me. He told me before even calling me he called attorney directly and told him letter was illegal he could not without any court papers tell marina owner to keep boat from me.(now if Monroe sheriffs would have done their jobs months ago and filed this as grand theft like they should have we wouldn't be here) Now if the Florida Department of Law Enforcement does their job and tells them they committed grand theft when they had no court papers to steal boat and charges all involved we will then be making head way. The people of Florida and anyone who owns a boat in south Florida should be keeping an eye on this case. I will update as more news becomes available.

Hotel attorney Alan eckstein makes promises to jacksonville man and doesn't keep them

Last week Alan eckstein ocean key resort hotel legal representative called Jacksonville man and told him they were refunding money. The attorney for Jacksonville man who bought boat sent hotel attorney letter giving hotel till last Friday to have money wired into account. Well Friday has passed no money. Monday attorney is given excuse and waits for money that night( nothing). As of today (Wednesday)speaking to Kevin man who bought boat from hotel they haven't heard a thing as of today except for a faxed letter yesterday saying money was on its way. This is what I've been dealing with for five months,lieing hotel manager,attorney doesn't return calls etc. As I've said all along its sad when attorney doesn't know the law makes mistake and keeps going like hes in the right. I hope Jacksonville man gets full money back its one step closer for me in showing their wrong in the action of stealing my boat. I will report to everyone as new information arises.

Jacksonville man says hotel has agreed to refund his money

I was in touch with jacksonville man who says alan Eckstein ocean key resort attorney was in touch with his attorney today and has agreed hotel will refund his money. Of course i called hotel corporate office today myself and was told by legal department they followed law and would not be returing my yacht. They told gentleman they sold yacht to a few weeks ago at auction that they had full ownership of yacht and guaranteed him a title to vessel. Well obviously they didnt get title and vessel is still in our name. wheather they wanna say it or not to give money back to jacksonville man who bought the stolen vessel from ocean key resort is an admission of guilt. the attorney i spoke to today from hotel corporate office tried to tell me i wouldnt get vessel back because they followed law to reposess (steal) yacht. After that he was in the middle of threatening me because of news publicity ive caused plus my blog but we got cut off. I will update as i hear more.

Lawsuits getting very close

After interviewing 21 prominent Florida attorneys I will be deciding very soon who will handle case. I intend on filing a number of law suits possibly including the Monroe county sheriffs office for their very poor or lack of investigation. I feel not only could Monroe county have taken necessary steps to make the proper arrests they totally ignored doing their job properly due to the deep pocket influence of the ocean key resort. After talking to other police departments in Florida and them looking at police reports we made in Monroe county everyone was surprised why this was pushed to a civil matter? We have a $175,000 yacht which deputy saw at hotel partially dismantled, then he went in to ask why boat was there he just took their word they had lien and left yacht there. No legal paperwork was ever shown. Even after he stated there were signs hotel partially dismantled vessel plus fresh wet towel's were on board where people had been on board using boat already. I was told by Jacksonville man last week who purchased this vessel at auction not only was this boat stripped, it was allowed by hotel to slam up against docks 24 hours a day because they improperly tied down or took care of. If Monroe county sheriffs did their job properly the severe damage would never had been done including fire on board. The poor man from Jacksonville who paid hotel $71,000 would not be out his money as of today if sheriffs did job properly.

Monroe Country Sheriffs ignore GRAND THEFT

Well as of today the vessel purchased by gentleman in Jacksonville Florida has been left at marina in Ft. Lauderdale.Tthe owner was told by attorneys representing him boat is definately stolen. After talking to sheriffs department in ft. Lauderdale and faxing original report to them filed with monroe county sheriffs department they were amazed this was not filed as GRAND THEFT. I just got off phone with a Ft. Lauderdale news station and one news paper this will be in the media soon so stay tuned. When will monroe county sheriffs department wake up and decide the bad publicity and the influence on them by deep pocket people in key west is not what they are there for.

wow alot has happened today

for those of you following heres what happened today. i was in touch with coast guard licensing agency regularily keeping an eye open for person who purchased vessel to file for new title. i got word new ownership papers were filed on my vessel and was given name of person who applied. i called gentleman who was in miami yesterday taking boat to jacksonville from key west. i told him boat was stolen and sold illegally. now this man not knowing me from adam was shocked. he called a very reputable maritime attorney in jacksonville after hearing my story and hired this man to help. i spoke to the boat purchaser again today he gave me attorneys phone number asking me to call i did. this attorney was just hired yesterday but his client told him what the story was i gave him and he was shocked. he told me (attorney)after talking to his client and finding out this boat was taken from out of area and brought back to hotel for them to claim statuate this attorney told the hotels attorney today by phone he represents the man who bought boat and told attorney under statuate 328.17 it is illegal to go take posession of a boat bring it back and claim this lien. (at this point he didnt talk with or even know me yet) so here you have a maritime attorney which doesnt even represent me telling hotel attorney yes its against law what they did. the man who bought boat was in ft. lauderdale florida today(about half way home) he left boat at marina got rental car heading all the way up state to meet attorney at 9am(hes not a happy camper)i was also told the week before auction he met with boat broker i was contracted with to sell boat which took him to see boat. after seeing boat he went back home called my broker the following sunday to make an offer on boat. the broker(which i had contract with)told him he didnt need to make offer to owner because hotel was auctioning boat off the next morning and he would represent him in the purchase. this past friday i spoke to broker involved he assured me that he had no knowledge of how the boat got in the hotels posession but after talking to the buyer and me getting the story he told me if he had the knowlege that the boat was taken the way it was he would have told new buyer when looking at boat and would have advised him not to purchase vessel. i will post more this week as it becomes available

u.s coast guard gets involved

while in touch with the u.s. coast guard today i was told the gentleman who purchased my stolen boat had applied for new title. i told coast guard boat was stolen and we did not authorise sale of vessel. i was asked to send in statement and its now my understanding title will not be transferred. i kind of feel sorry for person who got in middle of this situation but also feel if you are purchasing something of this value and getting it for a price much lower than value its best to do your homework. i also talked to a federal group today and gave my statement as to the theft of boat im hoping a full investigation will be done and arrests and charges be brought up on all individuals involved in theft. i will keep everyone posted as i hear more.

state internal affairs returns verdict in less than 24hours

what a joke? i was told by investigator that nothing wrong was done in reguards with the f.w.c. handling case. he says there are no policies the f.w.c.has that says how an officer is to handle boats adrift. where the hell is common sense? a police office is stupid enough to give away a $200,000 boat to someone coming up to them with no paperwork, and a bull shit story saying they are in charge of boat. with as many boats that go adrift in florida for many reasons they have or claim not to have any policies on how boats of this matter are to be handled. (amazing)
